1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of SurvHey, including the SurvHey iOS application and the survhey.com website (collectively, the "Service"), operated by Core Dump Software LLC ("we", "us", or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

SurvHey is a survey creation and response collection platform. The iOS application allows you to design, manage, and publish surveys. The website hosts published surveys and collects responses from respondents. Key features include:

• Visual survey designer with 10 question types
• 50+ built-in survey templates
• Real-time response analytics and charts
• Multi-language survey support
• Survey sharing via links, QR codes, and short codes

3. Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account through the iOS app. You agree to provide accurate information and keep your account credentials secure.

3.2 Account Responsibility

You are responsible for all activity that occurs under your account. You must notify us immediately if you believe your account has been compromised.

3.3 Account Termination

You may delete your account at any time through the app. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Billing

4.1 Free Plan

SurvHey offers a free plan that allows you to publish 1 live survey and collect up to 50 responses. The free plan includes access to all question types, built-in templates, analytics, and multi-language support.

4.2 Paid Plans

Paid subscriptions (Basic, Pro, and Enterprise) are available as in-app purchases through the Apple App Store. Paid plans increase the number of live surveys, response limits, and unlock additional features such as custom templates and branding.

4.3 Billing

All subscription billing is handled by Apple through the App Store. Subscriptions auto-renew monthly unless cancelled. To manage or cancel your subscription, use your iPhone's Settings app under Subscriptions. Apple's terms and refund policies apply to all purchases.

4.4 Plan Limits

Each plan has specific limits on the number of live surveys and responses per survey. If you downgrade your plan, existing surveys and responses are preserved, but you may not be able to publish new surveys or collect new responses until you are within your plan's limits.

5. Acceptable Use

You agree not to use the Service to:

• Collect sensitive personal data such as Social Security numbers, financial account numbers, or health information unless you have proper legal authority and security measures in place
• Create surveys that contain or solicit illegal content
• Distribute spam, phishing attempts, or malicious links through surveys
• Impersonate another person or entity
• Attempt to access other users' accounts, data, or surveys without authorization
• Overload, disrupt, or interfere with the Service or its infrastructure
• Use automated systems (bots, scrapers) to submit false survey responses
• Collect survey responses from children under 13 without proper parental consent as required by law

6. Content Ownership

6.1 Your Content

You retain ownership of all surveys, questions, templates, and branding images you create or upload ("Your Content"). By using the Service, you grant us a limited license to host, display, and transmit Your Content solely to operate the Service (e.g., displaying surveys to respondents).

6.2 Survey Responses

Survey responses belong to the survey creator. We act as a data processor on your behalf. You are responsible for how you use, store, and share the responses you collect.

6.3 Our Content

The Service itself, including its design, built-in templates, code, and branding, is owned by Core Dump Software LLC and protected by intellectual property laws. You may not copy, modify, or redistribute the Service.

7. Survey Respondents

If you are responding to a survey:

• You do not need to create an account
• Your responses are submitted to the survey creator
• Responses are anonymous by default unless the survey asks for identifying information
• By submitting a response, you agree that the survey creator may view and use your answers

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Service Availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any downtime or data loss.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, either express or implied
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the 12 months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless Core Dump Software LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
